Agreeing to Terms

By signing up as a client of Hostee or using www.hostee.online, you agree to be legally bound by these conditions. Please read these terms of service carefully. Hostee may change these terms at any time by updating this page. You should visit this page periodically to review these conditions, as they are binding to you. If you do not agree with ALL of these terms, then you are expressly prohibited from using the site and must discontinue use immediately.

Intellectual Property Rights

The Site, unless otherwise specified, is our exclusive property. This encompasses all source code, databases, functionality, software, designs, audio, video, text, photographs, graphics (collectively referred to as the “Content”), and any service marks and logos on the Site (the “marks”). These are either owned, controlled, or licensed by us and are safeguarded by copyright, trademark, intellectual property, and unfair competition laws of the United Kingdom, as well as laws in foreign jurisdictions and international conventions. The replication, distribution, republication, downloading, reproduction, sharing, posting, or transmission of any materials from this Site is strictly prohibited without express permission from Hostee.

Refund Policy Requirements

It is always our goal to make sure you have the best experience when using the Hostee service. The purpose of our 14-day money-back guarantee is to ensure new customers have the opportunity to test Hostee out risk-free. These are the requirements to qualify for the refund policy.

To qualify for a refund policy:

1. Must accept a call from an Account Manager to help walk you through Hostee and show you our features.
2. Must not have asked for any updates to be processed

Eligibility for refund is nulled if…

1. You post an update request.

If you do receive a refund all work created for you up to that point remains the property of Hostee. It cannot be used by your brand in any way.

Early termination/cancellation

You can cancel your plan at any time by emailing our support team. Your services will be stopped at the end of your current payment cycle. Once your services have ended we do not keep any copies of your websites and your backups will be deleted.

User Representation

By using the Site, you represent and warrant that:

1. All registration information you submit will be true, accurate, current, and complete.
2. You will maintain the accuracy of such information and promptly update such registration information as necessary.
3. You have the legal capacity and you agree to comply with these Terms of Use.
4. You are not a minor in the jurisdiction in which you reside.
5. You will not access the Site through automated or non-human means, whether through a bot, script, or otherwise.
6. You will not use the Site for any illegal or unauthorized purposes.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse all current or future use of the Site (or any portion thereof).

User Registration

You might need to register on the Site. You agree to maintain the confidentiality of your password and will be accountable for all activities under your account and password. We retain the right to delete, reclaim, or modify a username you choose if we decide, at our sole discretion, that the username is inappropriate, offensive, or objectionable in any way.

Disclaimer

The site is provided on an "as-is" and "as-available" basis. You agree that your use of the site and our service will be at your full risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the site and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranties or representations about the accuracy or completeness of the site’s content or the content of any websites linked to the site, and we will assume no liability or responsibility for any:

1. Errors, mistakes, or inaccuracies of content materials.
2. Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the site.
3. Any unauthorised access to or use of our secure servers and/or any personal or financial information stored therein.
4. Any interruption or cessation of transmission to or from the site.
5. Any bugs, viruses, Trojan horses, or the like which may be transmitted to or through the site by any third party.
6. Any errors or omissions in any content and materials, or for any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the site.

We do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the site, any hyperlinked website, or any website or mobile application featured in any banner or other advertising.

Limitations

Under no circumstances will Hostee, our employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including but not limited to lost profits, lost revenue, loss of data, or other damages resulting from your use of the site.

Corrections

There may be information on the Site that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.

Your Uploaded Content

Any material uploaded to our platform or sent via email, including but not limited to text, documents, PDFs, images, and videos, is considered "Your Content." All materials and content you submit for your design request or projects remain your property. You bear complete responsibility for all content submitted and its use in the completed design. We do not conduct any copyright, trademark, or licensing research for your content. Whatever you provide will be used as-is, and you are responsible for the work Hostee returns to you.

Responsibility for Your Content: You acknowledge that you are solely responsible for Your Content. You affirm that you hold all necessary rights to Your Content and that by posting it, you are not infringing or violating any third party's rights.

Permission to Use Your Content: By posting Your Content through our Dashboard or submitting it via Email, you grant Hostee a license to use it. We will never claim ownership of your content, but we reserve the right to use both published and unpublished work on our website and in advertising materials. You retain exclusive rights to your content and any licenses you hold. You are simply granting us permission to use it.

Rights You Grant Hostee: By posting Your Content, you grant Hostee a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of Your Content to provide the Services and to promote Hostee.

Reporting Unauthorized Content: If content that you own or have rights to has been posted to the Services without your permission and you wish it removed, please contact us via email. If Your Content infringes another person's intellectual property, we will remove it upon receiving proper notice.

Inappropriate, False, or Misleading Content: You agree not to post any content that is abusive, threatening, defamatory, obscene, vulgar, or otherwise offensive or in violation of our Terms. You also agree not to post any content that is false and misleading or to use the Services in a manner that is fraudulent or deceptive.

Fees and Refunds

You agree to pay the monthly or yearly fees stated at registration in full each month before Hostee renders any services under this Agreement. You also agree to authorize Hostee to automatically charge your payment method for the fee on each anniversary of your registration date, according to your billing frequency (e.g., monthly or annually). Your account and access to services and files may be suspended if applicable fees are not paid. You confirm and guarantee to Hostee that your billing information is accurate, current, and that you are authorized to make the payment.

You can cancel our services at any time by contacting support@hostee.online or speaking with a representative. Upon cancellation, we will keep your logins and account active, allowing you to access all previously submitted files until the end of your current billing period. Hostee reserves the right to change our pricing and offerings at any time without prior notice.

Ownership, Copyright, Trademark, and Provided Files

All design and original source files created while you are enrolled with us are yours to keep and own. You must provide our designers with sufficient content and instructions to complete the work. All files submitted to Hostee must be owned by you and not be stolen from another entity. You are 100% responsible for all materials submitted to us to create designs for you. Even in the completed design that we submit to you, we are not liable for any infringement on intellectual property rights.

You agree to indemnify, defend, and hold harmless Hostee and its affiliates, officers, members, managers, agents, successors and assigns (the “Indemnified Parties”) from and against all claims, demands, liabilities, damages, and costs including, without limitation, its reasonable attorneys’ fees, arising out of or relating to (i) your breach of any of the terms of this Agreement, (ii) your use of the services provided according to the Site, and (iii) infringement of third party’s intellectual property rights or other proprietary rights.

Hosting

Our hosting platform is run by WPMUDEV and Krystal Hosting depending on the size and scale of your accounts. Both use green energy initiatives to proved green hosting. Exact specifications for your chosen hosting package can be supplied at request, but all of our features standards can be found here.

Website updates

Hostee develops websites & landing pages on WordPress using your existing theme. All pages and articles will be built with existing theme structural components. If an update request is made that requires additional development then the user will be notified of the cost associated with that.

Website optimisation

Hostee uses WordPress optimisation plugins that are created by WPMUDEV. The WordPress optimisation suite is only active whist you have an active subscription. On cancellation of your subscription from Hostee your support and updates for the optimisation plugins will be stopped. You can create your account with WPMUDEV at your own cost to keep your updates & service active, pricing for this can be found here.

Releasing Completed Work

We hold ourselves to a high standard of delivery and would never intentionally submit final files with errors to you. However in the rare event that you do receive a file with errors, please notify us promptly and we will do our best to quickly make the revisions and re-submit to you. Hostee is not liable for any loss of business or loss of revenue incurred from errors in our updates. Please make sure you check the update before signing it off.

Confidentiality

All communication between you and any Hostee representative are held confidential. We will not disclose your private information or project information with unauthorised users.

Delivery Output

You may submit as many update requests as you humanly can and all requests will be stored on our management software and prioritised accordingly. Our team will work on one at a time for you including revisions. For us to move on to the next project, your current project must be fully completed and approved. You can also Pause or Cancel an update if you no longer wish for that project to be completed. Pausing or Canceling an update will instantly stop its production and allow our team to move on to the next in line.

Site Management

We reserve the right, but not the obligation to:

1. Monitor the Site for violations of these Terms of Use.
2. Take appropriate legal action against anyone who, in our sole discretion, violates the law of these Terms of Use, including without limitation, reporting such user to law enforcement authorities.
3. In our sole discretion and without limitation, refuse, restrict access to, limited the availability of, or disable (to the extent technologically feasible) any of your contributions or any portion thereof.
4. In our sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems.
5. You will not access the Site through automated or non-human means, whether through a bot, script, or otherwise.
6. Otherwise, manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.

Third Party Websites and Content

Hostee has not reviewed or approved all sites linked to its Internet website. Hostee is not responsible for any contents of any such linked websites. 3rd Party Links does not imply endorsement by Hostee. Please use your best judgment and discretion when using such links.
